1. General Provisions

1.1. These online store rules (hereinafter – the Rules) are a legally binding document for the Buyer and the Seller (hereinafter – the Seller), setting out the rights and obligations of the Parties.

1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes to the Rules on the online store’s website.

2. Conclusion of the Purchase and Sale Agreement

2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the online store, having first read these Rules.

3. Rights of the Seller

3.1. In the event of important circumstances, the Seller may temporarily or completely suspend the operation of the online store without prior notice to the Buyer.

3.2. If the Buyer attempts to harm the operation, stability or security of the online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer’s access to the online store without warning.

4. Obligations of the Seller

4.1. The Seller undertakes to provide the opportunity to use the services of the online store, the operating conditions of which are set out in these Rules.

4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, in accordance with the conditions set out in these purchase and sale Rules.

4.3. When, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online store, the Seller has the right to terminate the Purchase and Sale Agreement after informing the Buyer. The Seller may offer an equivalent item. If the Buyer declines, the Seller undertakes to refund the money paid within 3 business days.

4.4. If the Buyer exercises the right provided for in clause 5.2 of the Rules, the Seller undertakes to refund the money paid by the Buyer within 5 (five) business days from the day the returned item is received.

4.5. The Seller may withhold the refund of the amount paid by the Buyer until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.

5. Rights of the Buyer

5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules.

5.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded with the Seller by notifying the Seller in writing (by email at [email protected], stating the item to be returned and its order number) no later than within 14 days of receiving the item.

5.3. The Buyer may exercise the right referred to in clause 5.2 only if the item has not been damaged, its packaging is intact, its appearance has not substantially changed, and it has not been used.

6. Obligations of the Buyer

6.1. The Buyer must pay for the purchased goods and accept them in the manner set out in these Rules.

6.2. If the Buyer refuses to accept the goods at the time of delivery without valid reasons, the Buyer must, at the Seller’s request, cover the costs of returning the goods.

6.3. At the time of delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the item(s) together with the Seller or the person who delivered the shipment.

6.4. If the Buyer refuses to accept the goods at the time of delivery without valid reasons, the Buyer must cover the costs of delivering the goods.

6.5. By using the online store, the Buyer confirms that they agree with these purchase and sale rules and must comply with them.

7. Prices of Goods

7.1. Prices of goods in the online store are indicated in euros. Prices include VAT. Upon confirmation of the order, a delivery fee, if applicable, is added to the total amount of the goods.

8. Ordering and Payment for Goods

8.1. The Buyer, having visited the online store, selects the items they like and adds them to the shopping cart. After forming the shopping cart, the Buyer enters the personal data necessary to fulfil the order: their first name, last name, the address to which the goods will be delivered, telephone number and any additional information that may be important for delivering the ordered goods. The Buyer confirms that they have read these Rules and confirms the order.

8.3. Payment can be made using the online banking services of Swed, Seb, Luminor, Citadelė and Šiaulių bankas, as well as Visa / MasterCard payment cards. Payments can be made in euros. Payments are processed using the MakeCommerce.lt payment platform.

9. Delivery of Goods

9.1. When ordering goods, the Buyer must provide the exact delivery address.

9.2. The Buyer must accept the goods in person. If the Buyer cannot accept the goods in person, but the goods have been delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding delivery of the goods to the wrong person.

9.3. The Seller delivers the goods to the Buyer in accordance with the terms indicated in the product descriptions.

9.4. The characteristics of all goods sold are indicated in the description accompanying each item. The Seller is not responsible for the fact that the colour, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.

9.5. In the event that the Buyer, in accordance with these Rules, withdraws from the purchase and sale agreement, they are obliged to pay all direct costs of delivering the goods to the Buyer and returning them to the Seller. The amount of these Seller’s costs is deducted from the money paid for the goods to be refunded to the Buyer.

10. Returns of Goods

10.1. Goods of proper quality may be returned within 14 days of the day they are received. Defects of sold goods of improper quality are remedied, and goods of improper quality are replaced or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.

10.2. When returning goods, the following conditions must be met:

10.2.1. The returned item must be in its original, undamaged packaging (this clause does not apply when a defective item is being returned);

10.2.2. The item must not have been damaged by the Buyer;

10.2.3. The item must be unused and must not have lost its marketable appearance: labels intact, protective films not removed, etc. (this clause does not apply when a defective item is being returned);

10.2.4. The returned item must be in the same configuration as received by the Buyer;

10.2.5. The Seller has the right to refuse to accept goods returned by the Buyer if the return conditions have not been complied with;

10.2.6. Returns of goods are carried out in the manner specified by the Seller within 14 (fourteen) days of the day the goods are received (this clause does not apply when the item is defective – in that case, returns are carried out within the statutory warranty period). The costs of returning the goods are borne by the Buyer;

10.3. Returns and exchanges of goods of proper quality are carried out in accordance with Article 6.22810(1) of the Civil Code;

10.4. Money paid for goods accepted but later rejected by the Buyer is refunded to the Buyer’s account no later than within 5 (five) business days from the day the item is returned to the Seller, unless the Seller and the Buyer agree otherwise.

11. Final Provisions

11.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

11.2. These Rules and the relations between the Parties in respect of these Rules are governed by and interpreted in accordance with the laws of the Republic of Lithuania.

11.3. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

11.4. The Parties are released from the fulfilment of their obligations under these Rules if their fulfilment is impossible due to unforeseen circumstances beyond the Parties’ control (force majeure).
